1.         Hans, who was seventeen years old, purchased a used car at Geneva Hughs’ Auto Lot for $2600.  Hughs made out the title and sales receipt in Hans’ name.  Hans drove the car to school several times during the following week and discovered that the main bearing was burned out.  He took the car back to the auto lot and was told by Hughs that it would cost between $1400 and $1500 to repair the car.  Hans refused to pay for any repairs, left the car parked on the lot, and a week later requested the return of his $2600.  Hughs alleged that because Hans’ uncle had given $1200 towards the purchase price of the car, Hans could not disaffirm the contract.  Hughs claimed that even if Hans could disaffirm the contract, Hughs did not owe him $2600, since the car suffered $750 in damages when a driver backed into Hans’ car the evening after he left it at Hughs’ lot.  Decide, discussing fully the arguments of both parties.     (75 points)Question 22.         The Safe Stop Co. was a brake manufacturing company.  It experienced great financial difficulties in the fall of 2007.  It had a chance to obtain the patent rights to a new brake which would last four times longer than other brakes on the market. Manufacturing this brake might put Safe Stop back on its feet.  Unfortunately, Safe Stop had a large debt outstanding – it owed Fast Financing Co. $2,600,000 for an overdue loan.  Safe Stop could not purchase the patent rights until it removed the debt owed to Fast from its books.Fast’s loan officer met with the officers of Safe Stop.  Safe Stop’s officers explained the whole situation, its desire to be able to purchase the patent rights and the fact that to obligate itself to buy the patent rights, which were very expensive, it would have to wipe clean the loan from Fast.  After some negotiation, the Fast Financing Co. and Safe Stop entered into a written agreement as follows: Safe Stop promised to pay $1,400,000 to Fast Financing, and in return, Fast promised to accept that amount as full and complete satisfaction for the loan to Safe Stop and thus to cancel the balance due of $1,200,000.  Safe Stop paid the $1,400,000.Pursuant to this agreement, Safe Stop purchased the patent rights at great cost.  Four months later Fast Financing sued Safe Stop to recover the balance of the loan – $1,200,000.  Safe Stop contended that Fast Financing has no right to the additional money.  Who will win?  DISCUSS the arguments of BOTH parties.   (100 points)Question 33.         Baker and Zale each contracted with Computer Information Services, Inc. to purchase shares of its stock.  Both believed the corporation had assets worth $11 million.  Zale later refused to go through with the purchase of the CIS stock on the grounds that the company did not have assets of $11 million as Zale had believed but instead had assets of only $4.5 million.  Zale refused to pay the corporation for the shares he had agreed to purchase from it.  As a result, the corporation sued Zale for breach of contract.  Can the corporation enforce the contract and recover the purchase price?  Why or why not?  What defense(s) can Zale raise?  EXPLAIN FULLY.    (75 points)

PERSONAL HEALTH AND WELLNESS…….. DISCUSSION BOARD DUE THURSDAY

Healthy vs. Unhealthy Relationships

Consider this scenario: Carrie has been dating John for three years. In the first year of their relationship, they were blissful and happy. Spending almost every day together, they often talked about marriage. Carrie was so happy that she started eating healthier and exercising on a regular basis. By the end of the first year, the novelty of the relationship wore off, and John paid less attention to Carrie. She became more anxious and often questioned their commitment to each other, and her exercise routine decreased. As the couple rounded the third year, John hit Carrie during an argument after she dropped a fork on the floor. John was apologetic and promised it would never happen again. Since she still loved him, she agreed to forgive him and try and make the relationship work. How might this relationship affect personal health and wellness for either partner?

There are many types of relationships. Sibling-to-sibling, parent-to-child, colleague-to-colleague, to name a few. Within these various relationships, the dynamics can range from healthy to unhealthy and can affect personal health and wellness in various ways. People often have difficulty recognizing whether a relationship is healthy or unhealthy. This could lead to some unanticipated consequences. Think about what constitutes healthy and unhealthy relationships and how they can impact personal health and wellness.

To prepare for this Discussion:

  • Review Chapter 5 in Health: The Basics, 10th edition.. Pay particular attention to what constitutes a healthy and unhealthy relationship.
  • Review Chapter 4 in Health: The Basics, 10th edition.. Focus on the intimate partner and interpersonal violence. Consider how you might prevent a violent or unhealthy relationship.
  • Review the multimedia piece “Dimensions of Health Wheel.” Pay particular attention to the impact relationships have on the dimensions of health for this week.

With these thoughts in mind:

By Day 4, post an example of a healthy or unhealthy relationship. Then describe two factors that might contribute to a healthy or unhealthy relationship. Finally explain two ways a healthy or unhealthy relationship might impact personal health and wellness.

Personal relationships can be rewarding and, at times, challenging. Think back to this week’s Discussion and what constitutes a healthy or unhealthy relationship. Consider your own relationships and think about how they impact your personal health and wellness.

In addition to considering your relationships, think about your spiritual health. Spiritual health is characterized by subscribing to a way of life or “a belief in a supreme being or a specified way of living prescribed by a particular religion” and it also may include “the ability to feel a part of a greater spectrum of existence” (Donatelle, 2013, p. 8). What brings meaning to your life and how important is your spiritual health to your personal health and wellness?

To prepare for this Application Assignment:Complete the following Personal Health Assessments in Health: The basics, 10th edition:

    • Chapter 5, “Building Healthy Relationships and Understanding Sexuality”
    • Chapter 4, “Preventing Violence and Injury”
    • Chapter 2, “Focus On: Cultivating Your Spiritual Health”

As you complete the assessments, consider the following questions:

    • How Well Do You Communicate?
    • Are You At Risk for Violence?
    • What’s Your Spiritual IQ?

Review Chapter 2 in Health: The Basics, 10th edition. Also, Review the article “Spiritual wellness, holistic health, and the practice of health education” located in the Learning resources. Focus on the impact of spiritual health on health and wellness.

Application Assignment (2–3 pages):

  • Summarize any insights you gained related to your relationships as a result of taking the Personal Health Assessment.
  • Explain how your spiritual health might impact your health and wellness.
  • Explain at least three ways you may attain positive spiritual health.

Research and discuss (with references) the movements by our government to censor freedom on the internet.  As a basis of discussion use U.S. Supreme Court decisions (NEW YORK v. FERBER, 458 U.S. 747 (1982)) and Osborne v. Ohio.  To build arguments and counter-arguments, lookup and read about what happened on April 16, 2002, when the Supreme Court of the United States in “Ashcroft v.
